FERPA & School Use Policy

JennyTalk may be used in educational settings, including schools, special education classrooms, therapy sessions, and home-based learning programs. Our platform is designed to support students with communication challenges, including those with IEPs (Individualized Education Programs).

Where JennyTalk is used in a school setting and student information is shared with us, we operate in compliance with FERPA as a "school official" acting on behalf of the educational institution.

This means:

• Student educational records are used only to provide the JennyTalk service
• We do not use student data for advertising, profiling, or commercial purposes
• We do not sell student data to any third party
• Schools and parents retain control over student educational records

Educational institutions and parents/guardians using JennyTalk in a school setting have the right to:

• Review all data collected for their student(s)
• Request correction of inaccurate student records
• Request deletion of all student data
• Restrict data use beyond core service delivery
• Transfer student data out of JennyTalk upon request

In an educational context, we may collect:

• First name (for personalization, optional)
• Communication phrases and vocabulary used in the app
• App usage patterns (for improving educational effectiveness)
• Parent or educator contact email

We do not collect:

• Social Security numbers or government IDs
• Financial information about students
• Biometric or health data
• Voice recordings
• Behavioral profiles for advertising

JennyTalk does not sell, rent, trade, or otherwise disclose student personal information to third parties for commercial purposes.

Data may be shared with service providers (such as ElevenLabs for text-to-speech) solely to deliver the JennyTalk service, under strict contractual data protection requirements.

Student data is used exclusively to support the student's communication and educational experience within JennyTalk. No student data is used to build commercial profiles or marketed to any party.

We maintain appropriate technical and organizational safeguards to protect student data, including encryption in transit and at rest, access control systems, and regular security reviews.

Schools wishing to deploy JennyTalk as part of a formal educational program may contact us to establish a data processing agreement that formalizes FERPA compliance obligations.
